Autoprice wrongly mentioned: Police does not seize with theft

Wrong data to the purchase price cost the insurance protection with a vehicle theft. The magazine reports “quite and harms” with reference to a judgement of the regional court Coburg.

In these cases the insurance it should be deceived and will therefore may assume achievement-free (file references: 13 O 314/06). The court rejected the complaint of a vehicle owner with its judgement against its partial all risks insurance on vehicles. The plaintiff had stated, its passenger car in Poland had been stolen from him. In the form for damage of the insurance it indicated a purchase price of 10,000 euro. In the calculation of the car dealer however only 7900 euro stood, as the insurance determined later.

The regional court stressed, the insurance is inevitably dependent on the honest assistance of the vehicle owners during the valuation stolen vehicle. Therefore it may refuse the adjustment of damages with wrong data - it is, the Versicherte can the assumption of deliberate deception conclusively disprove.
